It had been alleged that on the 29th of May 2020 an officer, in the presence of colleagues within a police station, used racist and discriminatory language. An officer of colour was present and the offensive language was in part directed towards that officer.
The use of the offensive language was found to fall below required standards of professional behaviour in respect of equality and diversity; authority, respect and courtesy; and also represented discreditable conduct.
A disciplinary panel determined that the actions of the disciplined officer represented gross misconduct. The panel went on to determine that dismissal without notice was the required outcome following such behaviour. That decision was reached in large part because of the critical need to uphold public confidence in the Devon and Cornwall Police. Dismissal was found to be required to underline that such language and behaviour will not be tolerated. It was also necessary to maintain public confidence in the fact that principles of equality and diversity will be fostered and protected by Devon and Cornwall Police, and that both officers and the wider public should be aware of the firm and unwavering commitment of Devon and Cornwall Police to deal with such behaviour.
