The Vulnerability Department has provided the following information.
Please may I request a list of which actions (made by/on behalf of Restrained Parties) constitute breaches of Restraining Orders and Non-Molestation Orders.
No information held; Devon & Cornwall Police does not hold a list of actions which constitute breaches for the above orders. His Majesty’s Courts and Tribunal Service will decide on the conditions of an order and a breach is, therefore, determined by the specifics of the order. If reported, we would record the breach and take action against the individual; there is no list of actions because actions breaching an order are on a case-by-case basis.
And, please may I also request information in relation to which actions fall under direct and indirect breaches respectively.
This is dependent on the specific court order in place. For example, direct and indirect conditions can be placed onto the order; if an order stated no direct or indirect contact, and contact was made, it would be a breach which we would record and take action for.
